A Tip, Teamwork, and a Successful Fraud Prosecution

At ICW Group, fraud prevention is a shared responsibility. Collaboration and persistence help protect the integrity of the workers’ compensation system. A recent Special Investigations Unit (SIU) investigation demonstrates how collaboration between Claims, SIU, defense counsel, ICW Group clients, and law enforcement can help uncover fraud and hold individuals accountable for material misrepresentations.

How the fraud scheme was uncovered

The claim involved an employee who reported a workplace injury and subsequently received temporary disability benefits. As the claim progressed, concerns arose regarding the consistency of the claimant’s reported limitations and activities outside of treatment. The matter was referred to SIU for further investigation.

One of the most significant developments occurred when an individual familiar with the claimant’s activities came forward and provided information suggesting the claimant was continuing to perform food delivery services through Uber while collecting disability benefits. The informant reported that the claimant was actively working, receiving income from Uber, and continuing those activities despite claiming an inability to work. The informant also provided supporting documentation that helped investigators verify and further explore these allegations.

The tip served as an important lead, but it was only one piece of the puzzle. SIU worked closely with the claims team and defense counsel to independently verify the information through surveillance, deposition testimony, medical reviews, and business records. Investigators also reviewed Uber’s records and other evidence to compare the claimant’s reported work status and physical limitations with documented activities.

Collaboration in Action

Throughout the investigation, the employer, claims examiner, defense counsel, SIU investigator, and outside partners shared information and coordinated efforts to ensure all relevant facts were thoroughly examined. This collaborative approach allowed the investigative team to identify inconsistencies and develop evidence supporting concerns that benefits were being obtained through material misrepresentations.

A successful prosecution

Based on the evidence developed during the investigation, the matter was referred to law enforcement for review. The injured worker was ultimately charged with insurance fraud and later pleaded guilty. As part of the resolution, the court awarded more than $19,000 in restitution to ICW Group, which was paid in full.

Best practices highlighted by this investigation

This case highlights several key fraud prevention best practices:

  • Take tips seriously. Information provided by coworkers, family members, business associates, or other knowledgeable individuals can help identify investigative leads that warrant further review.
  • Verify allegations through independent evidence. Successful investigations rely on objective evidence rather than assumptions.
  • Collaborate early and often. Open communication between Claims, SIU, policyholders, legal partners, and law enforcement creates better investigative outcomes.
  • Use multiple investigative tools. Surveillance, records analysis, social media and open-source research, witness information, and subpoenas can each provide valuable pieces of evidence.
  • Document concerns and preserve evidence. Proper documentation can be critical when matters are later referred for prosecution.

The Value of SIU

Workers’ compensation fraud increases costs for employers and diverts resources away from legitimately injured workers who need benefits and support. SIU investigations help ensure claims are evaluated fairly and objectively while protecting policyholder resources.

In this case, a concerned informant’s tip, combined with diligent investigative work and strong cross-functional collaboration, helped uncover fraudulent activity, resulted in a criminal conviction, and led to the recovery of funds through court-ordered restitution. It is an excellent example of how working together can protect the integrity of the workers’ compensation system and deliver meaningful results for policyholders.
